1. บทนำและฐานทางกฎหมาย

บริษัท กินสุข จำกัด ("บริษัท", "เรา") ในฐานะผู้ควบคุมข้อมูลส่วนบุคคล มุ่งมั่นคุ้มครองข้อมูลส่วนบุคคลของท่านตาม พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (PDPA) และกฎกระทรวง ประกาศ และแนวปฏิบัติที่ออกโดย สำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล (PDPC)

เราประมวลผลข้อมูลส่วนบุคคลของท่านบนฐานทางกฎหมายต่อไปนี้ ตามมาตรา 24 และ 26 แห่ง PDPA:

• ความยินยอม (Consent) — คุกกี้วิเคราะห์และการตลาด
• สัญญา (Contract) — การให้บริการแพลตฟอร์มและประมวลผลคำสั่งซื้อ
• ประโยชน์โดยชอบด้วยกฎหมาย (Legitimate Interest) — ความปลอดภัยของระบบ การป้องกันการฉ้อโกง
• หน้าที่ตามกฎหมาย (Legal Obligation) — การปฏิบัติตามคำสั่งของหน่วยงานกำกับดูแล

2. ข้อมูลที่เราเก็บรวบรวม

2.1 ข้อมูลที่ท่านให้แก่เรา

• ชื่อ-นามสกุล, อีเมล, เบอร์โทรศัพท์ (สำหรับการสมัครสมาชิก)
• ข้อมูลสุขภาพและโภชนาการที่ท่านบันทึกผ่านแอปพลิเคชัน
• ที่อยู่สำหรับจัดส่งและข้อมูลชำระเงิน (สำหรับการสั่งซื้อ)

2.2 ข้อมูลที่เก็บโดยอัตโนมัติ (เมื่อได้รับความยินยอม)

• ข้อมูลการใช้งานเว็บไซต์ผ่าน Google Analytics 4 และ Google Tag Manager
• หมายเลข IP, ประเภทเบราว์เซอร์, ระบบปฏิบัติการ, หน้าที่เข้าชม, เวลาที่ใช้งาน

2.3 ข้อมูลที่ได้จากบุคคลที่สาม

• ข้อมูลจากการเชื่อมต่อ Apple Health, Google Fit, Garmin หรือแพลตฟอร์มสุขภาพอื่น ๆ

4. การเปิดเผยข้อมูลแก่บุคคลที่สาม

เราอาจเปิดเผยข้อมูลของท่านแก่:

• ผู้ประมวลผลข้อมูล (Data Processors): Google LLC (Analytics/GTM), บริการชำระเงิน, บริการจัดส่ง — ซึ่งถูกผูกพันตามสัญญาให้ใช้ข้อมูลตามที่เราสั่งเท่านั้น
• หน่วยงานรัฐ: เมื่อมีคำสั่งตามกฎหมายหรือกระบวนการทางศาล

เราไม่ขายข้อมูลส่วนบุคคลของท่านแก่บุคคลภายนอก

5. การส่งหรือโอนข้อมูลไปต่างประเทศ

บางบริการของเรา (เช่น Google Analytics) จัดเก็บข้อมูลในเซิร์ฟเวอร์ต่างประเทศ เราดำเนินการให้มั่นใจว่ามีการคุ้มครองข้อมูลในระดับที่เพียงพอตามมาตรา 28 แห่ง PDPA และประกาศของ PDPC ว่าด้วยหลักเกณฑ์การส่งหรือโอนข้อมูลส่วนบุคคลไปยังต่างประเทศ

6. ระยะเวลาการเก็บรักษาข้อมูล

• ข้อมูลบัญชีและสุขภาพ: ตลอดอายุสมาชิก + 1 ปีหลังจากปิดบัญชี
• ข้อมูลธุรกรรม: 5 ปี (ตามกฎหมายบัญชีและภาษีอากร)
• ข้อมูล Analytics: 14 เดือน (ค่าเริ่มต้นของ Google Analytics)
• บันทึกระบบ (Log): 90 วัน

7. สิทธิของเจ้าของข้อมูล

ท่านมีสิทธิตาม PDPA ดังนี้:

• สิทธิในการรับทราบ (Right to be Informed) — มาตรา 23
• สิทธิในการเข้าถึงข้อมูล (Right of Access) — มาตรา 30
• สิทธิในการแก้ไขข้อมูล (Right of Rectification) — มาตรา 35
• สิทธิในการลบข้อมูล (Right to Erasure) — มาตรา 33
• สิทธิในการระงับการใช้ข้อมูล (Right to Restriction) — มาตรา 34
• สิทธิในการโอนย้ายข้อมูล (Right to Data Portability) — มาตรา 31
• สิทธิในการคัดค้าน (Right to Object) — มาตรา 32
• สิทธิในการถอนความยินยอม — มาตรา 19(3)

ยื่นคำร้องได้ที่ privacy@ginsuk.com เราจะตอบภายใน 30 วันนับจากวันที่ได้รับคำร้อง

8. การร้องเรียนต่อ PDPC

1. Introduction and Legal Basis

Ginsuk Co., Ltd. ("Company", "we") as a data controller is committed to protecting your personal data under the Personal Data Protection Act B.E. 2562 (PDPA) and guidelines issued by the Personal Data Protection Committee (PDPC).

We process your personal data under the following legal bases (Sections 24 and 26 of the PDPA):

• Consent — analytics and marketing cookies
• Contract — platform service delivery and order processing
• Legitimate Interest — system security and fraud prevention
• Legal Obligation — compliance with regulatory orders

2. Data We Collect

2.1 Data you provide

• Name, email, phone number (account registration)
• Health and nutrition data you log in the app
• Delivery address and payment details (purchases)

2.2 Automatically collected data (with consent)

• Usage data via Google Analytics 4 and Google Tag Manager
• IP address, browser type, OS, pages visited, session duration

2.3 Data from third parties

• Data from Apple Health, Google Fit, Garmin, or other connected health platforms

We may disclose your data to:

• Data Processors: Google LLC (Analytics/GTM), payment processors, logistics providers — contractually bound to act only on our instructions.
• Authorities: when required by law or court order.

We do not sell your personal data.

5. Cross-border Data Transfers

Some services (e.g. Google Analytics) store data on overseas servers. We ensure adequate protection as required by Section 28 of the PDPA and PDPC announcements on cross-border transfers.

6. Retention Periods

• Account and health data: lifetime of membership + 1 year after closure
• Transaction data: 5 years (tax and accounting law)
• Analytics data: 14 months (Google Analytics default)
• System logs: 90 days

Under the PDPA you have the right to:

• Be informed (Section 23)
• Access your data (Section 30)
• Rectify inaccurate data (Section 35)
• Erase data (Section 33)
• Restrict processing (Section 34)
• Data portability (Section 31)
• Object to processing (Section 32)
• Withdraw consent at any time (Section 19(3))

8. Complaints to the PDPC

If you believe your rights have been violated, you may lodge a complaint with the Personal Data Protection Committee (PDPC) at www.pdpc.or.th
