1. การยอมรับข้อกำหนด

การเข้าใช้งานเว็บไซต์ ginsuk.com และแอปพลิเคชัน Ginsuk ("บริการ") ถือว่าท่านยอมรับ ข้อกำหนดการใช้งานฉบับนี้ ซึ่งมีผลผูกพันตาม พระราชบัญญัติว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ พ.ศ. 2544 และที่แก้ไขเพิ่มเติม ซึ่งกำกับดูแลโดย สำนักงานพัฒนาธุรกรรมทางอิเล็กทรอนิกส์ (ETDA)

หากท่านไม่ยอมรับข้อกำหนดเหล่านี้ กรุณางดเว้นการใช้บริการ

3. การลงทะเบียนและบัญชีผู้ใช้

• ท่านต้องมีอายุไม่ต่ำกว่า 13 ปี หรือได้รับความยินยอมจากผู้ปกครอง
• ข้อมูลที่ลงทะเบียนต้องถูกต้องและเป็นปัจจุบัน
• ท่านรับผิดชอบต่อการรักษาความลับของรหัสผ่านและกิจกรรมทั้งหมดในบัญชีของท่าน
• แจ้งเราทันทีหากพบการใช้งานบัญชีโดยไม่ได้รับอนุญาต

4. ลักษณะการให้บริการ

Ginsuk ให้บริการแพลตฟอร์มติดตามสุขภาพและโภชนาการ ซึ่งรวมถึงการบันทึกอาหาร การวิเคราะห์โภชนาการ และคำแนะนำที่สร้างโดย AI

ข้อควรระวัง: ข้อมูลและคำแนะนำบนแพลตฟอร์มมีวัตถุประสงค์เพื่อให้ข้อมูลทั่วไปเท่านั้น ไม่ถือเป็นคำแนะนำทางการแพทย์ การวินิจฉัยโรค หรือการรักษา กรุณาปรึกษาแพทย์หรือผู้เชี่ยวชาญด้านสุขภาพก่อนเปลี่ยนแปลงพฤติกรรมการรับประทานอาหารหรือการออกกำลังกาย

5. การซื้อขายสินค้าผ่านแพลตฟอร์ม

การซื้อขายผ่าน Ginsuk Shop อยู่ภายใต้ พระราชบัญญัติว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ พ.ศ. 2544 และ พระราชบัญญัติคุ้มครองผู้บริโภค พ.ศ. 2522 ราคาสินค้าแสดงในสกุลเงินบาทและรวมภาษีมูลค่าเพิ่ม (VAT) 7% แล้ว

นโยบายการคืนสินค้าและการขอรับเงินคืนเป็นไปตามที่ระบุในหน้าสินค้าและอีเมลยืนยันคำสั่งซื้อ

6. ทรัพย์สินทางปัญญา

เนื้อหา รูปภาพ โลโก้ ซอฟต์แวร์ และองค์ประกอบอื่น ๆ บนแพลตฟอร์มเป็นทรัพย์สินของบริษัทหรือผู้อนุญาต ได้รับความคุ้มครองตามกฎหมายทรัพย์สินทางปัญญาของไทย ห้ามทำซ้ำ ดัดแปลง หรือเผยแพร่โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษร

7. เนื้อหาที่ผู้ใช้สร้าง

ท่านให้สิทธิ์แก่บริษัทในการใช้เนื้อหาที่ท่านส่งหรือเผยแพร่ผ่านแพลตฟอร์ม โดยไม่มีค่าตอบแทนเพื่อวัตถุประสงค์ในการให้บริการและปรับปรุงแพลตฟอร์ม ท่านรับรองว่าเนื้อหาดังกล่าวไม่ละเมิดสิทธิ์ของบุคคลที่สาม

8. การจำกัดความรับผิด

บริษัทไม่รับผิดชอบต่อความเสียหายทางอ้อม ความเสียหายพิเศษ หรือความเสียหายที่เกิดจาก การใช้หรือการไม่สามารถใช้บริการได้ เว้นแต่ที่กฎหมายไทยกำหนดไว้เป็นอย่างอื่น ความรับผิดสูงสุดของบริษัทจำกัดอยู่ที่จำนวนเงินที่ท่านชำระให้แก่บริษัทในช่วง 12 เดือนที่ผ่านมา

9. กฎหมายที่ใช้บังคับและการระงับข้อพิพาท

ข้อกำหนดนี้อยู่ภายใต้กฎหมายไทย ข้อพิพาทที่เกิดขึ้นจะยื่นต่อ ศาลที่มีเขตอำนาจในกรุงเทพมหานคร เว้นแต่กฎหมายจะกำหนดเป็นอย่างอื่น

10. การแก้ไขข้อกำหนด

บริษัทสงวนสิทธิ์แก้ไขข้อกำหนดเหล่านี้ได้ตลอดเวลา โดยจะแจ้งให้ทราบล่วงหน้า 30 วัน ผ่านทางอีเมลหรือการแจ้งเตือนบนแพลตฟอร์ม การใช้บริการต่อเนื่องหลังจากการแก้ไข ถือว่าท่านยอมรับข้อกำหนดฉบับใหม่

3. Accounts

• Registration information must be accurate and kept current.
• You are responsible for your account credentials and all activity under your account.
• Notify us immediately of any unauthorised access.

4. Nature of Service

Ginsuk provides a health and nutrition tracking platform including food logging, nutritional analysis, and AI-generated suggestions.

5. Purchases

Purchases via Ginsuk Shop are governed by the Electronic Transactions Act B.E. 2544 and the Consumer Protection Act B.E. 2522. Prices are in Thai Baht and include 7% VAT.

Return and refund policies are stated on individual product pages and in order confirmation emails.

6. Intellectual Property

All content, images, logos, software, and other elements on the platform are owned by the Company or its licensors, protected under Thai intellectual property law. Reproduction, modification, or distribution without written permission is prohibited.

7. User Content

You grant the Company a royalty-free licence to use content you submit through the platform for the purposes of providing and improving the Service. You warrant that your content does not infringe third-party rights.

8. Limitation of Liability

The Company is not liable for indirect, special, or consequential damages arising from use or inability to use the Service, except as required by Thai law. Our maximum liability is limited to amounts paid by you in the preceding 12 months.

9. Governing Law and Disputes

These Terms are governed by Thai law. Disputes shall be submitted to courts of competent jurisdiction in Bangkok, unless otherwise required by applicable law.

10. Amendments

We may update these Terms at any time with 30 days' advance notice by email or platform notification. Continued use after amendments constitutes acceptance of the revised Terms.
